High Court re-confirms Actavis approach for determining claim scope of variants

Fisher & Paykel Healthcare Ltd v Resmed Ltd [2017] EWHC 2748 (10 November 2017)

 

Hot on the heels of the Supreme Court's ruling in Eli Lilly v Actavis UK Ltd (see our full analysis here), the High Court has confirmed for the second time that the "Actavisapproach" is now the law for determining claim scope of variants.
