IP Happy Hour – Patent Litigation in Asia

Effectively Enforcing Patents – Even in the Far East!

 

Companies are repeatedly confronted with patent-infringing counterfeits originating from Asian countries. These counterfeits are typically produced more cheaply there and subsequently enter the European market at significantly lower prices.

 

The suppliers, particularly in the consumer goods sector, often use well-known online platforms as sales channels and are frequently difficult to identify. As a result, companies face practical challenges, such as the proper service of a complaint for patent infringement. Against this background, it can be advisable to focus on the manufacturer of the products. However, this shifts the legal dispute abroad, provided that the patent owner also holds patents in the manufacturer's country of residence. If this is the case, there is generally the possibility of taking legal action against the manufacturer, for example in China, particularly seeking injunctive relief and damages for patent infringement. However, companies are often unfamiliar with the national particularities of such proceedings. It is therefore difficult to assess how promising such action would be in a specific case, how long proceedings might take, and what costs would be involved. Another recurring question is which evidence must be presented to the respective national court to prove a patent infringement.

 

With our IP HAPPY HOUR series "Patent Litigation in Asia," we aim to provide information on the typical course of patent litigation proceedings in the particularly relevant Asian markets of China, Japan, and India, over the course of three events.

 

For this purpose, we have invited experts from the respective countries, who will also be available for questions following their presentations.
