IP Happy Hour – Patent Litigation in India
Effectively enforcing patents – even in the Far East!
Time and again, companies become aware of patent-infringing counterfeits originating from Asian countries. These imitations are typically produced at lower cost and consequently reach the European market at significantly reduced prices.
The suppliers – particularly in the consumer goods sector, where well-known online platforms are often used as sales channels – are frequently difficult to identify. As a result, companies face practical challenges, such as the proper service of a patent infringement complaint. Against this backdrop, it can be advisable to focus on the manufacturer of the products instead. This, however, shifts the dispute abroad, provided that the patent owner also holds patents in the country where the manufacturer is based. If so, it is generally possible to take legal action against the manufacturer – for example in China – for patent infringement, in particular seeking injunction and damages.
However, companies are often unfamiliar with the specific national procedures in such cases. It is therefore difficult to assess how promising such an approach might be, how long proceedings may take, and what costs are to be expected. There is also the recurring question of what evidence would need to be presented before the national court to substantiate a claim of patent infringement.
With our IP HAPPY HOUR series “Patent Litigation in Asia”, we aim to provide insights into the typical course of patent litigation proceedings in three key Asian markets – China, Japan and India.
To this end, we have invited local experts from each country who will be available for questions following their presentations.
We are delighted to welcome Ms. Anju Khanna and Ms. Nancy Roy as speakers for our third session on “India.”
The Speakers

Dr. Anju Khanna – Patent Partner at Lall & Sethi
Dr Anju Khanna heads the Patent Department and is in-charge of both patent prosecution and patent litigation at the firm. She has more than 23 years of work experience with nearly 22 years in the field of patents. Dr Khanna obtained her PhD in Chemistry from the Indian Institute of Technology, Delhi and later worked as a post-doctoral researcher at the Institute. She oversees and handles work in different technology domains including chemistry, pharmaceutical, medical devices, electrical and mechanical inventions, life sciences, agro-chemistry, telecommunication, AI & ML, to name a few.
She is actively involved with the Indian Patent Office and organizations like Niti Aayog and the Confederation of Indian Industry (CII) in policy decision making and regularly engages with them in this regard. She is a vocal supporter of modernization of the Indian Patent Act and has been engaging with the Government on issues like the working statement requirements, including decriminalization and easing of such requirements.

Nancy Roy - Litigation Partner at Lall & Sethi
Nancy has been practicing in Courts all over India, including the Supreme Court of India, Delhi High Court, Madras High Court, Calcutta High Court, Bombay High Court, District Courts and Tribunals since the year 2010 and has argued matters independently as well as assisted Senior Advocates in heavily contested litigations and has handled and supervised heavily contested litigations. Apart from that Nancy has also been appointed as an Arbitrator for several cases.
