The entry into force of the UPCA has been postponed by two months, to 1 June 2023, as announced by the UPC today.

 

This is because of technical problems accessing the Case Management System using the required authentication. 

 

As a result, the sunrise period for the UPC (for opt outs) is also postponed by two months, to 1 March 2023. 

 

Requests to delay grant and early requests for unitary effect can be filed at the EPO from 1 January 2023. We do not expect this to be postponed.
